  1. PROCEDURES FOR FILING A DMCA TAKEDOWN NOTICE

If you are a copyright owner or an authorized agent thereof and believe that any content on Lakayou infringes upon your copyrights, you may submit a formal written notification. To be legally effective, your notice must include the following information:

  1. Electronic or Physical Signature: A signature of the person authorized to act on behalf of the owner of the copyrighted work.
  2. Contact Details: Your Full Legal Name, Mailing Address, Telephone Number, and Email Address.
  3. Identification of the Copyrighted Work: A detailed description or a link to the original work that you claim has been infringed.
  4. Identification of the Infringing Material: The specific URL(s) on Lakayou where the material is located. We require direct links to locate the content efficiently.
  5. Good Faith Statement: A statement that you have a “good faith belief” that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy Statement: A statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

  1. COUNTER-NOTIFICATION PROCEDURE

If you believe that your content was removed by mistake or through misidentification, you have the right to file a Counter-Notice. This must be sent to support@lakayou.com and must include:

  • Your physical or electronic signature and contact information.
  • Identification of the material that has been removed and the location where it appeared before removal.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Dawsonville, GA if your address is outside the U.S.).
  1. REPEAT INFRINGER POLICY

Lakayou maintains a zero-tolerance policy regarding repeat infringement. We reserve the right, in our sole discretion, to terminate the accounts or access of any users, vendors, or contributors who are repeatedly flagged for intellectual property violations.

  1. LEGAL WARNING: MISREPRESENTATION

Please be advised that under Section 512(f) of the DMCA, any person who knowingly and materially misrepresents that material or activity is infringing may be held liable for damages, including costs and attorneys’ fees, incurred by the alleged infringer or by Lakayou.
